I agree wholeheartedly that we need to gain and maintain control of our borders and that that is the duty of the Federal Government (specifically Congress) under the Constitution.

I believe that the current situation is a kick in the teeth to those (Mexican/Latin American/all others -- including my great-grandparents) immigrants who stood or are standing in line to follow the legal processes of entry and gain either student/temporary/permanent residency status under the law and, indeed, progress if they so choose toward naturalization. Further, from a human rights perspective, the illegals are at risk of physical and sexual abuse and employment at what amounts to slave labor status (work for this wage or I'll turn you in; sell your body on the streets for me or I'll turn you in, run drugs for me or I'll turn you in, etc.).

Most of the illegals coming from Mexico are not hardened criminals (although there are certainly some of these). Most come because there is no future for them where they live (no job, no education, no food) just as with the millions who came from Europe (Irish potato famine, refugees from war or persecution, peasants, and unskilled laborers, etc.).

That said, the situation is untenable as it is and something must be done. In a number of cases, we can certainly inflict harsher penalties on the traffickers of humans and the employers who preferentially hire illegals so that they can pay lower wages than they would have to pay legal residents/citizens. We can and should beef up border security and turn around illegal entrants sooner, before they have a chance to become entrenched. It is, IMHO, unlikely that we would line up railway cars and ship 10-12 million people (assuming we can find them all) back "where they came from" (not all are Hispanic, several of the 9/11 hijackers were illegally here on expired student visas), nor is there any practical likelihood of changing the Fourteenth Amendment citizenship by birthright. There needs to be some kind of temporary worker permit which requires registration and getting on the tax rolls, a reasonable path to eventual legitimization for those who have been here more than 10 years -- this should include fluency in English, a return to their homeland for a period of six months and being at the end of the line for permanent residency status. All others should be subject to fines and need to return for at least one full year before any application for permanent status. Many agricultural workers get temporary work permits (e.g. Jamaican apple picker in New England and New York). This can be a solution for those working the vegetable and/or dairy farms. The border security is key, though...no plan for dealing with those already here can work if there is no barrier to entry for millions more.

Finally, something needs to be done to attack the source of the problem. The US and Mexican governments are cooperating in the fight against illegal drugs; they need to cooperate in the creation of meaningful jobs in the border states of Mexico. If US corporations are "off-shoring" work to Russia, India, and China, why not "off-border" it to Mexico -- set up education centers and high-intensity English-language programs and run the call centers our of Chihuahua instead of Bangalore. The more decent-paying jobs in Mexico, the fewer people looking north for economic reasons.

Could not such a charge equally have been made against Reagan, Clinton, and both Bushes? The vast number of illegal's did not come here just in the past 20 months...'

That is so true, and it's what I have been saying all along, that there are a whole lot more than 11 or 12 million illegal's in this country right now.
There is no real way for anyone to know just how many there are. I never was happy with Reagan when he granted them amnesty, either. Maybe there didn't seem to be any other choice, but it still didn't make it right. Now, we are facing the same dilemma. Are we just going to keep granting them amnesty every few years, as more and more cross our borders? Or, as Obama wants, just open up the borders and let who ever wants to come flooding in. There were loonies advocating that over 20 years ago, too. Does America belong to us, the Americans, or to the whole world? Europe allows people to move around wherever they want to, but they also require papers. The same as we do. Are the hispanics allowed to go in and out as they see fit, while everyone else has to go through the legal steps? We can't just lock or close out borders, but we certainly have a right to manage who comes in. As for Biden, I think I would almost welcome him as potus about now. He is relatively harmless in comparison. I think that the next two years are going to be very 'interesting.'

Learn from the mistakes of others. Life is too short to make them all yourself.

The impeachable offense that would definitely fly, IMHO, is his absolute failure in protecting the citizens of our country against illegal immigrants. By refusing to enforce the federal law on immigration and directing his Justice department to file frivolous lawsuits against the State of Arizona, and now against a college in the same state, his actions violate his oath and rise to the level of "High crimes and Misdemeanors".

Hopefully, but not practically, my congressional rep will be gone in November, so I'll wait until then to send my second letter about a lame duck Congress not being stupid enough to railroad any more radical pieces of legislation through in the last two months of their term.

If the outcome of the elections is close to what I think they will be, we will have close to a 50/50 split in the House (I would be ecstatic if it was 51 for the good guys and 49 for the others). It would be totally awesome if Pelosi was knocked from Speaker of the House to Minority Whip.

In the Senate, there is a chance we'll go from 40/60 to 45 to 55, maybe even a touch better.

I strongly believe that the Dems will not be able to make a bill filibuster proof.

Unless B Hussein Obama declares a National Emergency and tries to take over the whole Federal Government, I don't see where he can legally hurt us much after January, 2011.

I PRAY that he doesn't try anything stupid.

I fell fairly comfortable that we will be able to win any fair election this year, and in 2012, we may be able to regain the control in the Senate and in the House. Unfortunately, right now I can't see getting a 2/3 majority in either the House or the Senate.

One seat that I think will now be more conservative is that of flip-flop Independent Lieberman.

True, but he is so inept that it would be painful, but not as painful as the fool we have now.

Would I like to see him impeached, Absolutely. Boehner has already said all the Czars are unemployed along with all their staffs, and Obama care will be zero funded so the new director in Obama's office is also out a job. Will see what happens in November and what they try to do after the election till January.
If they continue to rush many bills through and he signs them by pushing them to pass before he loses power could be used. Really the only real impeachment would be his birth certificate or lack of a certificate.

Whether or not you believe that any or all of the charges in this article are true, none of them rises to an impeachable offense under the Constitution. There is NO Constitutional prohibition of "political intimidation", especially of members of one's own party. Deals have been struck and favors granted/reprisals threatened since Washington's day. The health care bill was passed by Congress...if it is held in part or in whole as unconstitutional be the Supreme Court, it still is not either a high crime nor a misdemeanor -- many acts of Congress signed into law by Presidents have been held to be unconstitutional (e.g. The Alien & Sedition Acts of 1798, the AAA and NRA acts of 1933, etc.), but in neither case were any of these acts impeachable. Regarding abortion, there is nothing there either -- whether you agree with Roe v. Wade or not, it is, according to the Constitution, the "Law of the Land" and no president can directly change that. As regards Federal funding of abortions, Reagan prohibited it by Executive Order on Federal property, Clinton overturned that prohibition, Bush reinstated it, Obama overturned the reinstatement. None of these were or are impeachable acts. Private funding by insurance companies is a matter for the private sector and/or Congress. The Constitution gives the Federal government specific authority (Article I, Section 8) to enact regulations for the naturalization of immigrants, and the president is given absolute authority (Article II, Section 2) to grant pardons and reprieves (amnesty) except in the case of an impeachment conviction. This has been used many times in the past (e.g. Carter pardons Vietnam War draft evaders, Reagan grants amnesty to illegal immigrants, Ford pardons Nixon, etc.). Finally, and most importantly, impeachment is a political act and there is no possibility of an impeachment bill being passed by the House (at least until January 2011) and, even after that, zero chance of at 2/3 majority for conviction in the Senate regardless of the results of the 2010 elections. Let's suck it up and save our energy for the 2012 election where something actually can be done.

This article from the Washington Times pretty well sums up the major reasons. How could we have all been so blind as to let things come to this pass?

*******

Jeffrey T. Kuhner, Washington Times September 10, 2010

President Obama has engaged in numerous high crimes and misdemeanors. The Democratic majority in Congress is in peril as Americans reject his agenda. Yet more must be done: Mr. Obama should be impeached.

He is slowly – piece by painful piece – erecting a socialist dictatorship. We are not there – yet. But he is putting America on that dangerous path. He is undermining our constitutional system of checks and balances; subverting democratic procedures and the rule of law; presiding over a corrupt, gangster regime; and assaulting the very pillars of traditional capitalism. Like Venezuela’s leftist strongman, Hugo Chavez, Mr. Obama is bent on imposing a revolution from above – one that is polarizing America along racial, political and ideological lines. Mr. Obama is the most divisive president since Richard Nixon. His policies are Balkanizing the country. It’s time for him to go.

He has abused his office and violated his oath to uphold the Constitution. His health care overhaul was rammed through Congress. It was – and remains – opposed by a majority of the people. It could only be passed through bribery and political intimidation. The Louisiana Purchase, the Cornhusker Kickback, the $5 billion Medicaid set-aside for Florida Sen. Bill Nelson – taxpayer money was used as a virtual slush fund to buy swing votes. Moreover, the law is blatantly unconstitutional: The federal government does not have the right to coerce every citizen to purchase a good or service. This is not in the Constitution, and it represents an unprecedented expansion of power.

Yet Obamacare’s most pernicious aspect is its federal funding of abortion. Pro-lifers are now compelled to have their tax dollars used to subsidize insurance plans that allow for the murder of unborn children. This is more than state-sanctioned infanticide. It violates the conscience rights of religious citizens. Traditionalists – evangelicals, Catholics, Baptists, Muslims, Orthodox Jews – have been made complicit in an abomination that goes against their deepest religious values. As the law is implemented (as in Pennsylvania) the consequences of the abortion provisions will become increasingly apparent. The result will be a cultural civil war. Pro-lifers will become deeply alienated from society; among many, a secession of the heart is taking place.

Mr. Obama is waging a frontal assault on property rights. The BP oil spill is a case in point. BP clearly is responsible for the spill and its massive economic and environmental damage to the Gulf. There is a legal process for claims to be adjudicated, but Mr. Obama has behaved more like Mr. Chavez or Russia’s Vladimir Putin: He has bullied BP into setting up a $20 billion compensation fund administered by an Obama appointee. In other words, the assets of a private company are to be raided to serve a political agenda. Billions will be dispensed arbitrarily in compensation to oil-spill victims – much of it to Democratic constituents. This is cronyism and creeping authoritarianism.

Mr. Obama’s multicultural socialism seeks to eradicate traditional America. He has created a command-and-control health care system. He has essentially nationalized the big banks, the financial sector, the automakers and the student loan industry. He next wants to pass “cap-and-trade,” which would bring industry and manufacturing under the heel of big government. The state is intervening in every aspect of American life – beyond its constitutionally delegated bounds. Under Mr. Obama, the Constitution has become a meaningless scrap of paper.

To provide the shock troops for his socialist takeover, Mr. Obama calls for “comprehensive immigration reform” – granting amnesty to 12 million to 20 million illegal aliens. This would forge a permanent Democratic electoral majority. It would sound the death knell for our national sovereignty. Amnesty rewards lawlessness and criminal behavior; it signifies the surrender of our porous southern border to a massive illegal invasion. It means the death of American nationhood. We will no longer be a country, but the colony of a global socialist empire.
