Wow, what a story!. I am so thankful for those other people in line who obviously supported you and knew this crap at the airports is way out of line--and as you say, unconstitutional. By the way I look for the "TSA" to start searches other places. I've heard they already have at places like train depots and at certain checkpoints. We'll have to "show our papers" and submit to a search just traveling from one point to another. In fact, we might have our "identification" embedded in us. Another 5 years of TSA at the airports and most people won't question searches at other places.

That is a great accounting!!! That search and seizure amendment has bothered me for some time. I'm so happy you were as prepared as you were. If only more people were. Sigh.

Something about this post has been tickling my brain now for the past three months and I can't believe I totally missed it. This whole TSA thing is a violation of our 5th Amendment rights against unreasonable search and seizure.

The evidence speaks for itself. How many Caucasian women have been caught trying to smuggle bomb parks or explosives on to airplanes since TSA started? Zero (0), that's how many. How many babies have been caught with a diaper bag full of explosives? Again, zero (0). How many Methodists, Catholics, Church of Christ members or any other Christian religion people have been found to be planning the overthrow of the government of the United States since the TSA was founded? Again, zero.

How many people's lives have been interrupted by this policy? Millions. How many grandmother types of any religion have had explosives on them? That's right, zero. I could go on and on, but the fact remains the same. Unreasonable search and seizure violations since late 2001.

What makes it even worse is that young people, the majority of them pre-teens, have been forced to do something they have been told all of their lives not to allow. I'm not sure if there are very many who have not been taught that they shouldn't allow any stranger to touch them in their private parts or submit to any unwanted touching at all. If I was a young girl and some TSA goon or goon-ness singled me out for a strip search, I would be freaking out. If I was traveling with either of my granddaughters, I might wind up in jail.

Maybe not, because I carry a pocket Constitution and a copy of Missouri's sexual violation law. I also go on-line and get a copy of the state to which I am flying and print off a copy of their sexual assault laws.

I have in internal defibrillator/pacemaker, so I'm used to needing to be personally wanded and hand searched. On one occasion, I asked the TSA agent if he had any reason to suspect I had explosives in my groin area. He said, "No", but started to search that area anyways. I told him to stop and he threatened to call the Airport Police. When the Police persons arrived (both a male and female officer arrived in response), the TSA agent told them I had refused to allow them to complete the required search. The cops, and that was what they were, they weren't the police, initially started threatening me with jail time if I didn't submit to the search.

When I finally got their attention with a copy of the Missouri law regarding sexual assault and unwanted touching, they got nervous and had to call their watch commander - a police Sargent. He arrived and we did the dance again, but this time to overcome the police tactic of screaming and trying to intimidate me, I told him what the TSA agent had said to me about their not being any indication I might have have any bomb or bomb making meterial packed around my groin - then I flashed the appropriate 5th Amendment, which he claimed had been over ruled by the courts and I pointed out a law passed by Congress could not be over ridden by any law and there had not been any amendment to the Constitution, then the Constitution still applied. Then I showed him a copy of the appropriate Missouri law defining sexual assault and unwanted touching and told him I would leave the airport and drive to the nearest offices of the ACLU, file a complaint and then I would contact my attorney and file Civil Suits against the specific TSA agent, his supervisor, the police who had arrived, the Police Sargent and the Police Department.

They huddled together, then made a call on the Police walkie-talkie and we waited. A man arrived, dressed in a suit and walking like a boss with his shiny black Corfams (a shoe that a majority of Police and military wear because they are so comfortable and are designed to shine brighter than normal dress shoes).

When they all finished their huddle, he came over to me and started trying to make nice to me with comments like, "It's no big deal; the agent was just doing his duty, yada, yada, yada and couldn't I just let them do their their jobs." I answered that I wasn't going to allow someone to search me, without probable cause, and violate my civil rights, an by the way, what was his name? He didn't want to give me his name, so I used my phone to take his picture. He demanded my phone and I told him it was evidence in a conspiracy to deprive me of my Constitutional Rights and I wouldn't give it to him. When he tried the lie about it being illegal to photograph Police Officers in the conduct of their duties, I told him a lie and quoted the Supreme Court decision that concluded just the opposite.

All this time, my voice was becoming louder and louder until the people going through the security line became obvious to what was happening. A young Marine Sargent stepped out of line and told them 'he wouldn't go through the x-ray machine, then a middle aged woman joined him, etc., etc., until there were almost as many people in the "hand search line as in the regular x-ray line. Additionally, most of them had started filming the whole thing or taking pictures.

The Suit finally said, do a standard police search, don't touch his groin area and let's get these people out of here.

They completed my search, begrudgingly, and I went behind the security area and started filming what was happening. The TSA agents, the police and the Suit were all completing their duties with no arguments, no searching of babies diapers and no sexual touching. The one thing I did notice was the TSA agents were "doing their job" with bright red faces. I imagine the next time I have to fly out of KCI, my name will be on some sort of list.

I have already talked to one of my youngest son's police friends and he has assured me that he or another friend would escort me onto my flight and we would walk right through Security. I can't wait.

I think I will make a copy of all the Amendments to the Constitution, and on Missouri laws on sexual assault and unwanted touching so I can just hand a copy to the TSA agents as I pass through.

Even if they did profile, it assumes they would follow up on it. The underwear bomber hit the CURRENT flags (paid cash, flying alone, no luggage, tkt bought that day or the day before, etc), yet, he managed to board with nothing more than normal scrutiny.
And then you have the guy who slipped past security and shut down an airport for 6 hrs. He's prolly getting jail time, but the TSA who was off talking on the phone and LET him slip by is getting a reprimand? At the least, he should be fired if not imprisoned himself.

My husband and I have talked about the idea in this article before and apparently it isn't all that new per the original publication date (2004). I think we should just start arming the TSA people with bomb sniffing pigs and perhaps spray guns of pig liquid pig lard. Maybe they could also have vendors outside of the airports selling freshly grilled pork and bacon sandwiches making sure the smoke wafts the air!
Has anyone thought that some of the TSA people ARE Muslin Extremists and that is how these people get through? Hey, infiltrate everything else. I haven't heard this aspect brought up!

I agree with a lot of you on profiling. It is a hard fact of life but one that is unfortunately necessary in the world we live in today.

All good comments. It only takes 1 person to add their voice to someone else, to start to speak up. Look at what the Tea Party Movement has started!

All because one man Rick Santorelli (sp) spoke up on national tv on the floor of the stock exchange about all the bail outs!We all need to be more involved in the process, or we will lose the freedoms and individualism of this great country The United States Of America.

We are all immigrants, our parents or grandparents came from other countries to make a better life for themselves. They worked hard and prospered.

The "new" immigrants from anywhere expect entitlements, as if we OWE them anything!

Wrong.

Work for it. Stop slamming this country, if it is so bad because we don't provide, have, or give, to you. Then go back to where you came from!!!!!

If it is so GREAT in your country, then WHY did you come here?!?!?!? Obviously it wasn't, or you would NOT be here. So just shut up AND LEARN OUR WAYS. This country is NOT an extension of your OLD country! Deal with it.

In case any one is interested, I was not born in this country. I was born in Munich Germany, am now a citizen of this country. The USA is MY country.

Thanks for listening to my rant!!! I'm SOOO tired of all the pc bulls**t !!

I really think it would be wrong if it would be done without cause, done to everyone, or even just randomly. I think it should be a last resort thing that takes place when you are proven to be suspect. Many of the search aspects they do now are beyond the need, but we did give that inch. The rest of you are right in saying profile. Why waste time with "random". I would think that you miss the "bad guy" when you are just trying to be "fair" with your checks.
Also they could really do with a family room to check people with little kids. I had my granddaughter one time and with all the things I had to jump through starting by taking a little one out of her stroller, computer out of case, shoes off, etc... she ran about 50 feet away into a crowd while I was struggling to gather things up. The people working did nothing to help or stop her. When I got her back and was unfamiliar with the stroller I still didn't have my shoes on and literally caught the sole of my foot in the thing when my sock got stuck. I had to rip my sock and and my foot bled into my shoe as I could do nothing about it until I reached home 10 hours later. The TSA people just wanted me out of the way so others could move through. It was a horrible way to start the trip. (which by the way started several hours earlier because of the distance from the airport.)
I watched a young father, that I over heard had just lost his wife, struggle with a baby who was crying while in line and TSA were so miserable to him. They kept complaining that he didn't put his bag on the belt in the right position and told him to move it the right way, all the while he was struggling with the baby and a bottle, shoes and all. I don't knw why they didn't put in the position they wanted it in the first place. It was awful, I wanted to offer help, but was unable to.

That is why everyone is so afraid to just come out and say things. God forbid that we "offend" them. If you don't like it then leave. I say tell the PC police to shut up and sit down!

LOL...(just what I was secretly thinking)...

I remember when the Patriot Act was introduced how I supported it. It was no skin off my back if the government wanted to listen to my phone calls and search my bags at airports. BUT...I was young and I didn't consider the corruptive ramifications of such policies. I'm starting to see how if you give an inch as far as your personal privacy goes (even seemingly for the greater good) a corrupt government will come in and seriously, SERIOUSLY abuse that. That's what really concerns me. If I could get a guarentee that this would STAY in the realm of safe travel on airplanes I'd gladly consent to a strip-search if need be when choosing to fly. But I'm not convinced that it would.

What are your thoughts about this? I'm still evaluating how I feel about this, personally. Part of me feels like "If I have nothing to hide, what's the big deal?" And another part of me sees what a slippery slope this could be...
