So Unfair...........

Friday afternoon, our youngest son and his fiance were in a car accident. They were driving on a rural road behind a large grain truck. The area is very flat and you can see for a long way. Our son pulled out a bit and checked the traffic coming toward him. There wasn't any so he put on his turn signal and pulled out to pass. All of a sudden, without a signal, the grain truck turned into our son's lane. Jerry put on the brakes and turned to the left to try to avoid the truck, but there was NO avoiding it. The car had the most damage on the left front passenger side. The truck kept going and dragged Jerry's car through a culvert and up into the driveway. At that point, the driver of the truck should have turned off his engine and left the truck where it was. Instead, he pulled all the way up into the driveway (where his boss lived). Jerry called the police and his insurance representative. It took the police a half hour to get to the accident. He asked the driver of the truck if he had turned on his turn signal and he said that he THOUGHT he had, but couldn't remember. At that point, the police should have checked to see if the signal was working. He didn't! Then the driver was asked for his driver's license and he didn't have it on him. He wasn't even asked if he had a CDL license. When the car hit the truck, it hit so hard that Jerry's fiance's head broke the windshield. Pieces of her hair were found in the windshield and on the mirror. She was crying and in pain and the police never asked if they needed an ambulance. Our oldest son arrived soon after the police and he is the one who took them to an area hospital where Sandy had a CT scan of her head and neck and x-rays of her chest arm and knee. No citations were issued when it was so obvious that the driver of the truck was at fault.

I spent all day yesterday talking to the Sheriff's Office to get a copy of the Police Report (this could take up to 10 days), trying to get in touch with the Insurance Company to talk to a Claims Representative, and also talking to the man who hauled Jerry's car away so we could get his belongings out of the car and put them in touch with the Insurance Company to look at the car themselves. After all of this, it may come down to Jerry not being treated fairly because of a botched Police Report.

Anyone ever have a similar experience and if so what did you do?

    ya this whole situation is wrong, first of all the cop should of said was anyone hurt ( how is your Sons fiance by the way. ) so was it the cops first day because anyone going by could see what happened...for all the dumbness going on I hope your Son gets some big bucks out of this.

    I am so sorry this happened. police should have call the rescue quad. Your sons gf could have serious injuries. hope things eork out.. you all are in my prayers.

    My mom was rear ended at a stop light, and the driver of the other car claimed it was her fault because she didn't accelerate fast enough when it turned green. He was the nephew of the chief of police in our village and the accident went on my mom's insurance!

    The police screw things up all the time. I got an attorney but nothing came of it. Sorry this happened. So thankful that your son and his fiancee are okay.

    Patti I am so sorry that this happened and so very grateful your son and his girlfriend are okay. I would agree with the others, maybe consult an attorney. I sure do hope things turn out with the insurance company in favor of your son.

    Oh Lordie, how scary, I hope your sons girlfriend went to hospital to be checked out.
    To be honest most road accidents over here are automatically visited by both police and ambulance when the emergency call is made.

    I am very sorry to hear of your youngest son and his fiance accident.

    My hubby had a similar situation in December 23, 2009. He was going out to get some last minute gifts for our little girl. It was snowing and the roads were slick when he approached an intersection where the light was green. All of a sudden a lady in a SUV made a left turn in front of him! When the police showed up, a witness said he saw the SUV pull in front of my hubby. His car was totaled and he was roughed up a bit as he was driving a Hyundai Accent. Two days later the officer came to our house to have him sign the accident report. My hubby asked if the other driver was issued a citation when the cop scolded him by saying, "That is none of your business." There was nothing he could do because the police had determined how they were going to handle it and that was that.

    Praise God they are alright!

    Oh my that is scary!! Prayers for you and your family! In the meantime, I think a call to an attorney is important! Let them handle it!

    Wow...maybe you should contact a lawyer? I hope everything turns out least no one was seriously hurt (or worse).
