Having worked for lawyers much of my life, I can tell you that it takes three or four years to get to the final outcome of a workman's comp claim. Not worth it unless you have become handicapped in some way that would show damages. Plus, you would have the devil's own time of finding another job in that city for sure. Maybe anywhere. You are right to try to stay working. I hate lawsuits! it is really the lawyers on both sides who make the money, trust me.

Yes Kelly, you are right about that. If you get your transfer and can work you would be better off.
I would leave the Workman's Comp alone.
Just be thankful that the Lord has blessed you as He has. Just my opinion.

Yeah, I've thought about going that way...with the workman's comp, but since everyone has that nerve and it wasn't something that was actually "caused" by something I "did" on the job, I'm not sure if they'll go for it. My doctor already told me it was because I was working the 12 hour shifts, but that was my choice. He told me he'd support me if I wanted to "go after the hospital in a suit" but I don't know if I want to do that either. I just want to find gainful employment (transfer) within my hospital and if I start yelling out workman's comp then that may not be good, ya know? Gotta think about my future, not just the now. Thanks for your input!

emoticon Sorry for the delay in posting, though this news made my day a couple of days ago. And, just off the top of my head (knowing nothing about the rules anywhere much less TX) maybe you can check into workmen's comp if the foot problem was aggravated by the job.

Are there provisions under your FMLA plan to get some compensation during your recovery period?

Sorry...FMLA=Family Medical Leave of Absence. Its for either oneself if ya get sick or to take care of someone in your family if they get sick. Or...if you've adopted a child or had a baby you can also take FMLA and it's supposed to protect your job for 12 weeks so you can get better and not have to worry about the possibility of losing your job during that 12 week period. Hope that helps! :o)

Hey y'all...thought I'd update everyone about what happened earlier this week. Remember how very upset I was last week after talking to my HR director and after I'd gotten the letter from my boss telling me that I would no longer have a job after August 16th? Well, apparently after I raised heck and complained that my hospital was just not doing some things right and that eventually they were going to have a lawsuit on their hands (I didn't know I was on FMLA and hadn't initiated FMLA), my HR director told me she'd call me back. On Monday while I was at the doctor's office she called and told me she'd call again. On Tuesday I got a call from my boss telling me she'd spoken with the HR director and since I didn't know I was on FMLA that I still had my job and that my FMLA was beginning on August 7th and I will have 12 weeks beginning Aug. 7th. All I needed to do was to bring in my doctor's note sometime this week, which I did. So...I still have a job! Not getting a paycheck, but hey, a jobs a job, right?

I did tell HR though that I'd like to transfer and now have 4 transfers in. Will see how that goes. I have a call in to the assistant recruiter from HR who has helped me before to see if she can speak with each of the hiring managers and see if she can put in several good words for me since she knows me and my plight.

I thank God for y'all and each of your continued prayers. My foot is actually doing better now after the second surgery. I talked with Mary tonight and realized I hadn't told y'all about my news. So sorry dear friends!
