A friend told me that the government is paying 65% of cobra thru Obama's stimulus plan. Your human resource or insurance company should have some info.

It is the law that they have to offer cobra, but it is really a joke, who in the world could afford 600.00 to 800.00 a month? that is insane.

Oh, darn. Our prayers are with you. Trying to find legal aid when you're laid up with your foot makes it doubly hard. Foot surgery's always dicey because the feet are used so much and because medical reimbursement and a common podiatrist subculture favors cutting solutions and then doesn't offer all the necessary rehab.

FYI, also seems strange your medical coverage ends at with the month. At the very least, they should've given you the COBRA lecture. But then job loss and medical expenses are the twin drivers for all foreclosures, which you've mentioned as another worry.

Something doesn't seems kosher, but I'm in no position to say what, only offer whatever empathy I (or more likely Tara and your Trio) can muster.

I'm also not sure whether there are different med/disability conditions here. Originally I remember you had a TIA (fainting) spell. Don't know if it was the diabetes or when it was diagnosed. Then I know you were back at work and your foot became the primary issue (and still is). It too can be a diabetes complication, but also clearly can be aggravated by some working conditions beyond the simple 12 hour shift time frame.

Don't know if they could be separated out in labor law, but in any event, you clearly have (had?) a bad boss. And from what I've heard there is a nursing shortage so somewhere else in the hospital might be able to accommodate you, even if you might be a probationary employee til Aug 16 (another possible reason for the odd date).

Anyway, good luck and Tara says I'm interrupting her beauty sleep....

P.S. I talked to a lawyer I used to work for after I spoke to you and he says that you should call your HR and tell them that your lawyer said that it is against every federal rule there is for her to threaten you while you are in the shape you are in, especially when the threat was wrong to begin with.

Thank you all...and thank you Jane. Actually my FMLA of 12 weeks will be up on Sept. 3. I immediately called my HR dept. when I got the letter from my boss since she seemed so adamant in her letter to me about termination on Aug. 16th "if I was not able to work my full 12 hour shifts". My representative advised me that she was wrong and could not terminate me on that date. Sandra fro HR also set me up with a phone call to the director of HR to help me find another unit to possibly return to once I'm able to go back to work since there does seem to be some issues with returning to my current place of employment. I don't really want to go back to work for such an individual, but I also don't want to leave my hospital I've been at for over a year now. Although, there are other wonderful opportunities here in my city that could be better for me...we'll see what God has for me. As long as I'm able to work soon and don't lose our home I'm good. Right now we're at risk of losing our house.

Aack! Sound like a Catch-22 that the poodles can't really help with (other than unconditional love, of course). You're in our prayers, but sounds like you still need to row, row, row....

I'm not a Texas lawyer, but found a couple of sites that might explain the situation a bit for you. Seems Federal law protects sick workers for 12 weeks, and Texas is one of the states that don't provide greater protections. But it might be wise to talk to an employment or disability attorney, or at least chat with the hospital's human relations person about your rights and COBRA benefits.

To prepare, you might want to think about whether your job caused or aggravated your foot condition, as well as find out the doctor's prognosis for returning and/or need for accommodations. Thank y'all. Unfortunately, just got a nasty little letter from my boss. States if I'm not back to work working my 12 hour shifts by Aug 16th, I will be terminated. Geez, this day just keeps getting better!

Here we go again! More surgery is on the way poodle friends. You can read my blog too I guess, or you can read it here. Went to the doctor today and he will re-open my incision on Friday to irrigate and drain it and make sure the nerve is okay. Then he will make another incision at the ankle and do ANOTHER nerve release to try to give me some pain relief. OMG...didn't sleep a wink last night and I am so exhausted. Have to go up to the hospital so I can pick up some sleeping pills. Just haven't been getting any rest so here I am with heavy eyelids!! I am not looking forward to anesthesia, I just get so sick from it and puke my guts out! YUCK. Will be back in a splint on Friday and non-weight bearing again come Friday.
