I just don't know. I am really mad at my Senator Chris Dodd for being a tool of the banking and insurance industry as well as some questionable real estate dealings. His Republican Senate opponent may be my former Congressman, Rob Simmons who was such a sycophant of Bush I would not vote for him under ANY circumstance. It is the classic lesser of two evils. Dodd has really lost his way for the past few years. What to do? Obama is really disappointing me...very Reagan like, all form and no substance...lots of high rhetoric and lack of follow through and too much a$% kissing of the GOP. I will have to trust that he may do something, but I am not as optimistic as I once was. I guess I naively believed in the "change" message. As Pete Townsend of the Who sang "Meet the new boss, same as the old boss." Politics in the U.S. is under the "golden rule." Those with the gold rule. No meaningful change until we have real campaign finance reform and transparency.

Turley's blog is a great site for issues on the law and I recommend it highly. He covers many current topics in the law and it is really well written and researched. Here's the link: jonathanturley.org/

I agree completely about the torture. I think that Obama is trying to apply the lessons of Nelson Mandela in S Africa and that he doesn't see the difference between S Afr and the US. We helped frame and then we signed the treaty about torture, which, as you point out, requires us to investigate our own violators of the policy.

How do we get his attention, but not just his attention, but his agreement to investigate and prosecute torture?

Jonathan Turley keeps making this point on Rachel Maddow. Frankly, he's beginning to sound like a Johnny-One-Note. So how do we keep addressing this issue and still keep people interested?

Russ, thanks my friend! Good to see you back and posting! I cannot get past the torture and civil liberties issues that my President has put in our midst. So far, he and Holder have been major disappointments, but after Gonzo the bar is set pretty low.

PIR8DAVE, thanks for the thorough and thoughtful review of law on torture. I couldn't agree more and I couldn't feel more helpless. I'm sure you've seen that Obama bridled when progressives met with him and told him that he was going down the same path as Bush.

I have to agree. North Korea is the cruelest and most oppressive state in the world. They feed their 2 million man army to prop up Kim Jun Il and his crazy regime while their people starve.

Only China has any sway with these Stalinist nuts and look how they treated their own people 20 years ago at Tieneman Square. They just don't seem to value human rights in China and North Korea as some in the West do. China really needs to pressure the North KOreans to release the journalists. Spies? What is their to spy on in this Orwellian throwback to Stalinist times?

Conservative attorney, Republican and Constitutional Scholar Bruce Fein (served Nixon, Reagan in the OLC, DOJ) said this on the wonderful Bill Moyers Journal May 3, 2009:

(Obama) "...he's agreed that what was done was torture, and that the United States criminal code makes torture a crime. And there's no national security exception, no exception if you get useful information. And because we had impeached, in the House Judiciary Committee, a former President, called Richard Nixon, for failing faithfully to execute the laws. How he can justify not moving forward with an investigation when we have a former President and Vice President openly acknowledging they authorized water boarding, what he has described as torture, is a crime.

Or in the alternative, if he thinks that there are mitigating circumstances, and there's body language suggests that, then he should pardon them like Ford did Richard Nixon. And the reason why the difference between a pardon and non-prosecution is important, is because a pardon requires the recipient to acknowledge guilt. That there was wrongdoing. There was a crime. Just forgetting and sweeping it under the rug suggests this wasn't illegal."

There is no "national security exception" to the U.S. Code. Torture is illegal under the US code and three international treaties. Ignoring the law for political reasons or convenience is not honoring the law that the President and his Attorney General swore "to ensure that the laws are faithfully executed." The truth is the truth...torture occurred (Obama, Cheney admit it) and it is ILLEGAL! The reason nothing has been done is the leadership in Congress is guilty of signing off on this in order to not be criticized as "not being tough on terrorists." (Pelosi, Reid, Rockefeller, Pat Roberts, et al. along with the former President, VP, AG, National Security Advisor, Sec of Defense.) We need an independent commission or special prosecutor NOW! Former Chief of staff to Colin Powell Col. Lawrence Wilkerson admitted to Congress 108 detainees have been killed in custody and at least 25 of them "were murdered." This is not about "the past;" Cheney and some on the right say we need to keep doing all these horrible things and Obama is continuing some of the programs at Bagram Airbase (Gitmo East) in Afghanistan.

Torture is not acceptable to protect the American people. This politics of convenience and subverting our laws and Constitution MUST stop.

"The Reagan administration strongly opposed torture with no exceptions Glenn Greenwald at Salon reminds us that former president Reagan (whose administration Fein worked for) signed and championed the Convention Against Torture.

Ronald Reagan, May 20, 1988, transmitting the Convention Against Torture to the Senate for ratification:

The United States participated actively and effectively in the negotiation of the Convention. It marks a significant step in the development during this century of international measures against torture and other inhuman treatment or punishment. Ratification of the Convention by the United States will clearly express United States opposition to torture, an abhorrent practice unfortunately still prevalent in the world today.

The core provisions of the Convention establish a regime for international cooperation in the criminal prosecution of torturers relying on so-called "universal jurisdiction." Each State Party is required either to prosecute torturers who are found in its territory or to extradite them to other countries for prosecution.

Convention Against Torture, signed and championed by Ronald Reagan, Article II/IV:

No exceptional circumstances whatsoever, whether a state of war or a threat or war, internal political instability or any other public emergency, may be invoked as a justification of torture. . . Each State Party shall ensure that all acts of torture are offenses under its criminal law."
