I filed separate. Its done infiled the first day I could should get it in 21 days. Tax preparer said too it was better for me to file separate.

You did the right thing by telling him to take a hike. I imagine it is all bark and no bite. He's just mad that he's in this spot. He brought it on himself. Don't even listen to his whining.

My EX just called yesterday to say that he had filed his taxes and has to pay in $1,300.00. He then stated that since he was married to me for 6 months of last year, he wants me to pay half! I told him no he needs to pay his own income taxes and perhaps change his deductions to zero with his employer.
He then went on to say how he does not want to make trouble for me but his tax advsior told him he could take me to court for it. I told him to go ahead, as we already have a signed and court approved divorce settlement agreement in which I deduct the kids in odd years and he deducts them in even years. Since I took on the debt of the home we shared, per our settlement agreement, I also get the deductions of being a home owner.
He then went on to say how all of his friends tell him he was stupid to let me have the home. Can you beleive that "Let me have it" I worked very hard to secure a mortgage in my name and have been making the payments on my own since July. Due to the current housing market there was no equity in the home. Therefore, I am the one who did him a favor and let him walk away from the debt.
Not to mention that I am the one who paid for the entire divorce proceedings including court fees so I could get it over with.
What kind of tax advisor tells their clients to take their EX-wives to court to pay for their
income tax??????????????????????????????????????????????

Well, my ex was in hot water with the IRS so I filed married, but separate, the last couple years before we divorced. If I filed with him, they would have taken all my money for his mistakes. I'd go with the lawyer's advice.

So last yesr we were on the verge of separation and the dh and I filed together but we split the refund. Since we will still be married when we file I was planning to do the same, however a lawyer I spoke to said it might be better if I file married filing single since I may way less than him because I would get a bigger earned child credit. Also that I should make sure I file firdt because I have physical custody of our daughter so he should not be able to claim her. He could if he files firdt then I'd have to go after him.
Anyone know about income tax? Is it better for me if I file single so I can get a bigger return? Any info would be helpful.
