This law merely codifies what has always been the law: if a light signal will not change because the sensors cannot or do not detect the vehicle's presence, you may proceed through the intersection if it's safe to do so. No one expects you to sit there for months waiting for the public works department to fix the light.

The difference is that instead of contesting the ticket and letting the judge decide - which in this jurisdiction is a far better option than trying to explain the law to the LEO who's writing the ticket - it should prevent the ticket from being written in the first place.

I could see potential wrinkles in the implementation of this...hoping NOT, but given the way these things usually go "the devil" is usually in the "details"...

Carry a copies of the statute with you. When the police pull you over you can educate them. It happens here.

Well, it is a statute. Of course it's poorly worded! Otherwise it would be three times as long.

And that is why we have lawyers, who can tell the judges what the poorly-worded statute means. And then the judge can ignore both of them, and make up his or her own mind.

I'm pretty fortunate: Law enforcement around here will leave cyclists alone as long as they're not dangerous. (If you're riding after dark with no lights, you will get stopped. If you fail to yield and cause a vehicle to nose dive to avoid hitting you, you will get stopped.) It helps that a significant number of officers on my local police force are riders. They've had the same problem with sitting through a light that cannot detect them.

It's great in theory...but if the signal fails to operate after one full cycle of the signal? If the signal isn't triggered because of the size of the motorcycle or bicycle...there is no full cycle of the signal. The signal does not cycle.

I realize that is the point, but the wording choice was poor and I forsee problems.

A new law will go into effect in June that allows motorcyclists to proceed through a red light if the light will not change because the sensor does not pick up their presence. Where I live, few sensors detect bicycles. Clearly, this will permit the same behavior by cyclists. (Although it's always been permissible to proceed through a red light if it's safe to do so and the light appears to be malfunctioning. And when a light never changes, I consider that defective.)

Here's the text of bill, as signed:

Notwithstanding any provision of law to the contrary, the operator of a street legal motorcycle approaching an intersection, including a left turn intersection, that is controlled by a triggered traffic control signal using a vehicle detection device that is inoperative due to the size of the street legal motorcycle shall come to a full and complete stop at the intersection. If the traffic control signal, including the left turn signal, as appropriate, fails to operate after one cycle of the traffic signal, the operator may, after exercising due care, proceed directly through the intersection or proceed to turn left, as appropriate. It is not a defense to a violation of RCW 46.61.050 that the driver of a motorcycle proceeded under the belief that a traffic control signal used a vehicle detection device or was inoperative due to the size of the motorcycle when the signal did not use a vehicle detection device or that any such device was not in fact inoperative due to the size of the motorcycle.
