I WON the appeal! I got a letter today and the judge ruled in my favor. The company can appeal within 20 days which they will probably do, but for the time being, I won!

I applied for unemployment and was denied. I decided to fight and appeal it.. I worked all day on Wednesday preparing my statement for the appeal hearing which was Thursday morning.
The judge called my ex-employer as the instructions said he would. The company gave him a phone number that was theirs, but went to voice mail and the box was full. They never participated. I won't know if I won until the end of October, but wow, maybe a I had a chance after all.

It seems participating in the appeal has "unchained" me from quite a bit of the depression. My family says I look 10 years younger, I am not having nightmares anymore, my SO doesn't have to kick me out the door to go to work, and he no longer worries if I am going to come if I was coming at all. I guess getting fired can sometimes be beneficial. In my opinion I was fired for bogus reasons. I hope the judge agrees with me.

The worst thing is the employer can appeal the decision. I don't think that is fair when they didn't attend the hearing. I don't think I should have to go through it again! emoticon

I decided to have an attorney help me fill out the form. He charges $260 for it, but I think it might be worthwhile.

hope it works out for you, but do be truthfull, and persistent. They will have a phone hearing with you, and then will send you a letter.

Work on it ASAP. When eldest son's company (he worked for) went under. It took "way too long" after filing for unemployment bene's to get any $$. Then it seemed like a constant battle (paperwork) to get payments.

File right away and answer all questions truthfully. Sometime if you were terminated for misconduct reasons, you will have a waiting period before you are eligible for benefits, also if you receive severance pay or annual leave pay, your benefits will not start until those funds are exhausted

Unemployment compensation varies state to state. It is ultimately up to the previous employer if they deny or not with the state. With the economy still how it is I don't think you would be denied. Did the previous employer tell you why you were being fired? If it was with just cause, i.e. you broke rules within the company, then you probably won't get unemployment compensation. On the other hand, if you were fired because they didn't have the work for you anymore, then you'd more than likely get unemployment compensation. Hope this helps.

The truth always prevails,tell everything as honestly as you can. Even if you lost ,remember this you told the truth ,yes perhaps you will not get justice,but the mind is free knowing you told the truth.then you are the winner. Yes it hurts if you have no benefits,but something else will happen to help you.

It's best to tell the truth. If you don't tell the truth and they discover you did not tell the truth, that's grounds enough for a denial. Or if they initially approved you for benefits, it would be grounds to terminate your benefits and expect you to pay back what you've already gotten. Really, would you want to go to a hearing for an appeal to an initial denial, and have to admit OUT LOUD that you lied on your initial application?

Just be truthful, and if you were terminated for something bogus and they deny you, fight it. Depending on cause you may not need an attorney. Hub went through this, got denied. He fought it and had enough proof that he did win his appeal.

I am finally coming out of the funk for - - - uhm - - getting "terminated" alternately known as "fired." . I want to fill out the form for unemployment benefits. Can anyone advise me what to say and what not to say? I have an attorney if they benefits are denied, but I'd like to get the benefits approved on the first try.
