Mexican weddings are not legal in the states, even with a license. You have to get married in the states as many go to the courthouse before going to a destination wedding out of the states.

We, too, got that sort of letter this year. We've been married going on 9 years now, and this is the first time we've had to prove it. But, I guess I can see why they wouldn't want to be paying benefits to anyone, if they are just taking their word for it. It would be considered insurance fraud if someone lied on their application forms about whether or not they were legally married. And, in some states, common-law marriage is not recognized, so insurance companies would not have to pay. At least that's my understanding.

It's absolutely not new. Years ago a friend of mine had to go through all sorts of hoops to prove she wasn't working because her husband's employer (a HUGE, major computer corporation) cut all spousal benefits if the spouse had any other option to get them. It's really, really hard to prove that you're NOT working! I can't remember why their tax return wasn't good enough as proof, but she had to show somehow that she wasn't doing any freelance work. They were even asking about whether she had gotten any thank-you gifts from the schools and churches where she did volunteer work.

And they had been married in Mexico, so she had to travel back there to get a copy of the marriage license; they won't do it by mail.

All of this was in summer of 2007 or 2008, so it's in no way related to ACA. The only surprise is that you didn't have to do all of this before.

I worked for an insurer for many years, and believe me there is fraud. Ultimately, all these requirements serve the employer who offers the insurance plan, as they pay for the biggest chunk of the cost. Without going into too much detail, it comes out of the employer's pocket now or later if someone is on the plan who should not be. First, they pay extra premium for the additional person; then they either pay extra claims out of pocket or get hit with increased premiums the next year for adverse claim experience (which in turn also affects the employee's co-workers, as their premium is higher too).

Yeah I had to provide all of this information most recently. Birth certs on all the kids. Marriage license, tax documents or they would drop us from insurance and we had a short window to provide all this information. I don't like these kind of restrictions. I get it though. I am sure lots of insurance fraud going on. It just seems wrong.

the spousal employment question may be related to changes due to health care reform.

DH's employer will no longer offer insurance to spouses who work for a company that offers it's employees insurance. I had to sign up for insurance with my employer because DH's insurance dropped me as of June 30.

what gets me is the HSA FSA thing. I can participate in the flexible spending account with my employer, but I cannot participate in the health savings account (my preference) because DH participates in an FSA.

It is not only legal, but fairly typical. Particularly if you are joining his benefits plan in the middle of the year as a "Change of Status." Some companies now charge the employee to offer spousal coverage if that spouse works. Hence the reason for asking do you work. Also, if you have coverage through your job, then they want to know they are only secondary coverage.

yes its legal.....and the reason why they ask if you work is because if you have insurance where you work then they want you to have your own. Insurance companies like making their own rules.

Wow I have never heard of that requirement but then again with our insurance being through DH, Commander in the Navy, we have to provide marriage cert for other programs.

When I married DH years and years ago, we needed to prove we were married, to the insurance company. This is nothing new. Like pp have mentioned, the insurance companies just want to verify that yes indeed you are legally married, and yes indeed if you say you do not work, you do not actually work (and possibly have coverage through another company). It's all about fraud. Has nothing to do with Obama or who was president when they started to do this. It has everything to do with money (the insurance company's money, that is).

Perfectly legal. There is so much insurance fraud it has to be done this way. Be thankful if you don't have to have a physical to cancel any pre-existing medical conditions. I had to have one once for work ages ago and the doctor the company sent me to wanted to do a pelvic exam. I put the brakes on that and thought whoa!

Does your husband get an additional benefit based on income level of the family? If he's enrolled in government insurance especially, they need to make sure he's not making only $10k a year, with you making $150k (for example).

Working status isn't something I would consider to be a private thing - not anymore than marital status.

Do something everyday that your future self will thank you for.

I got the same letter and it is legal. With all the insurance changes and laws changing insurance companies can ask for proof of all of this.
Just use a sharpie and black out your ssn's. They don't need that and it even says in the letter to black them out.
I had to send all of that as well as my sons birth cert. It is a pain in the butt but getting taken off the insurance would be way worse... I am not sure how good the insurance will be soon anyway but better to have it then not.

The tax return part is because they show that we may have a secondary coverage and that can determine if the company has to cover as as much as they have been up to this point.

Why would it not be legal?

Being married has lots of financial benefits. I see nothing wrong with having to prove that you are eligible for these benefits.

What is so hard about sending them a copy of the document?

Dances: salsa (standard/LA), casino, rueda de casino, cumbia Colombiana, bachata, mambo, cha-cha-chá, merengue, reggaetón.

Currently learning: Mexican cumbia, danzón, Cuban rumba

Dances to Learn in the future: flamenco, tango Argentino, samba, belly dancing, bhangra, ballroom rumba

You can try asking about this on the craigslist legal forum, but you ultimately are probably going to have to comply with this. The health insurance provider has a huge legal team to go over everything they do with a fine toothed comb. You can call the county office where you were married to try to get the required documentation.

I just received a letter from hubby's insurance asking me to send a copy of our marriage license and first page of tax form to prove we're married and I'm eligible for his insurance and to make sure I don't work, you ever hear of this????????????
Is this legal?
