As many of you know I am Custodial Guardian/Conservator of Estate for my now 40 yr old son, Erik. About 2 1/2 years ago I asked a contractor to draw me up a plan to get Erik a more adult size room with a fully handicap bathroom. He did it and I approached our lawyer about possibly using Erik's monies to pay for it. OH BOY, did I start something. Next thing I knew was I had to get two more sets of plans with cost estimates. We had to write up a proposal, get a court form and on the docats(sp) for a hearing with the probate judge (costs money) to explain why I thought we should be allowed to use Erik's funds for the addition. We had the hearing, the judge approved my reasoning, the concept and picked the plans we are to use-no choice by me, but he had a condition. The court appointed attorney would have to draw up a document stating that Erik would not EVER be left without a place to live. However we would not put his name on my deed for various reasons. Well we waited, our lawyer called her, e-mailed her, sent her letters and still....nothing... nada.... rien! So in the meantime I retired because of all the caregiver issues we were having and could not get a loan to pay for it myself. I was getting annoyed, building costs are going up so I told my lawyer I was going to be like the widow in the Bible-the one with the unjust judge. I called routinely, I asked if we could get another court appointed attorney.
I even went and created a trust fund for Erik, changed my will setting up a secondary trust where all of my monies, etc would go to be used for the care of Erik and when he dies, divided amongst his siblings/nieces & nephews. Finally a week and a half ago, my lawyer said, "Get it started, Ginie. You've met all the conditions."
I contacted the judge chosen contractor and am waiting for him to approach the county for a variance on my septic so we can get our building permits. My SIL will be doing the electrical for us and my eldest son will help him. This should save me/Erik some money.
I can see I'm going to have an arguments with the contractor because Erik will not need a handicapped sink but one with a higher cabinet. I already had a discussion with him about the windows on the plans not being what I asked for.... So no travels until this is done, but it's not off the ground yet-it's still at the beginning of the runway waiting again for the county-just not the courts!
I will NOT let this get me down. Erik WILL have the room HE wants.
We just need to be patient! emoticon emoticon

    My family as in the construction/rental business and there are always some snafus that occur when doing this kind of work. You are on your way though!!

    Glad you finally have approval Ginie. There sure is a lot of red tape to get things done. Patience is a virtue they say, but sometimes we need patience right now. Am praying that once it starts everything will go smoothly for you and Erik will get his room.

    Wow!! The amount of red tape you have gone through is amazing -- and I'm sure each step of the red tape required huge amounts of paper to put it through. Congratulations on getting to the beginning of the runway. I hope it isn't too long to take-off and that the result will have been worth the wait. In the meantime, take good care of yourself!!

    The red tape is such a pain. It sure has been a long time. Did you ever think of asking for help from Eriks Physicians since they would know both of you.
My Dr helped us to get long term care insurance. It does sound like you have gone it alone. I hope it is now ready to be completed and both of you will be happier when it is done.

    Frustrating, but a step in the right direction!

(Do you think you could draw up a kind of blueprint of what you and Erik want, so the contractor has something physical to go with? I did that for our classrooms when they rebuilt the school, and it helped a lot.)

    Well, it isn't going to be a coast but it will be so worth it and it already is worth all the headaches you went though since when it's done it will be a big improvement for you and Erik providing him with some comfort and independence in his life and probably less difficulties/arguments for you since I know when he's frustrated and unhappy he shares that with his mom. Deep breath friend and let's see....maybe a glass of wine and a good book for you? LOL

    I'm so pleased this project is now off the ground for you. Why is it so difficult for people to understand the urgency of a situation. Obstacles seem to be placed at every corner. I've been in a similar situation. Don't let it get you down. God wants what's best for Erik. He will see it through with you.

    As usual, it sounds like you are doing a really good thing for Erik. You are always thinking about what you can do to help him. I'm not sure where you even come up with some of your ideas but they are genius. I think it would be wonderful for Erik to have his own personalized space set up just for him. It's bound to make him feel secure and content. As I've said before, you are a fantastic mother.

    That is such a huge undertaking but I know you will get out done. Just don't get too stressed out. It will be so fantastic when it's finished and great for the both of you. Make sure to take care of yourself through this entire project.
