As many of you know I am Custodial Guardian/Conservator of Estate for my now 40 yr old son, Erik. About 2 1/2 years ago I asked a contractor to draw me up a plan to get Erik a more adult size room with a fully handicap bathroom. He did it and I approached our lawyer about possibly using Erik's monies to pay for it. OH BOY, did I start something. Next thing I knew was I had to get two more sets of plans with cost estimates. We had to write up a proposal, get a court form and on the docats(sp) for a hearing with the probate judge (costs money) to explain why I thought we should be allowed to use Erik's funds for the addition. We had the hearing, the judge approved my reasoning, the concept and picked the plans we are to use-no choice by me, but he had a condition. The court appointed attorney would have to draw up a document stating that Erik would not EVER be left without a place to live. However we would not put his name on my deed for various reasons. Well we waited, our lawyer called her, e-mailed her, sent her letters and still....nothing... nada.... rien! So in the meantime I retired because of all the caregiver issues we were having and could not get a loan to pay for it myself. I was getting annoyed, building costs are going up so I told my lawyer I was going to be like the widow in the Bible-the one with the unjust judge. I called routinely, I asked if we could get another court appointed attorney.
I even went and created a trust fund for Erik, changed my will setting up a secondary trust where all of my monies, etc would go to be used for the care of Erik and when he dies, divided amongst his siblings/nieces & nephews. Finally a week and a half ago, my lawyer said, "Get it started, Ginie. You've met all the conditions."
I contacted the judge chosen contractor and am waiting for him to approach the county for a variance on my septic so we can get our building permits. My SIL will be doing the electrical for us and my eldest son will help him. This should save me/Erik some money.
I can see I'm going to have an arguments with the contractor because Erik will not need a handicapped sink but one with a higher cabinet. I already had a discussion with him about the windows on the plans not being what I asked for.... So no travels until this is done, but it's not off the ground yet-it's still at the beginning of the runway waiting again for the county-just not the courts!
I will NOT let this get me down. Erik WILL have the room HE wants.
We just need to be patient! emoticon emoticon

    Dealing with government is SOOO taxing. No pun intended. Glad you are being persistent and insisting on what Erik wants. I can't even begin to imagine what you are going through. Just know that thoughts and prayers are with you and your family.
