It's really raining! Woo hoo!

Thursday, June 13, 2013

I love the rainy season. It makes everything so fresh and clean. It is pouring this morning. I am waiting for it to ease up so that I can get out for a little walk with the doggies.

Then I have an appointment with the dentist down the hill. It appears I will have to have a crown as part of the tooth broke as well. But the good news is that they have this new technology that is computerized and they make the crown the same day! It's the latest greatest thing. So I am excited that I can get it done in one day and happy that it will only cost like $340 US dollars compared to what one pays in the states for this new technology I think it's a good price. What do you all pay for crowns now?

Then my DH and I have to head to Guadalajara today to meet with our attorneys. The good news is that the higher court upheld the decision that the lawsuit the neighbors brought against us(the criminal charge) was completely unfounded and without any merit at all. It still amazes me how here in Mexico you can find an attorney to simply lie and find witnesses who will also lie. But we are free of all charges after 4 years of pain and suffering on this whole deal. For those of you that haven't followed this, the neighbors sued us for disposition of property. We own an easement that gives them the right to park a couple of cars on our property. these people went belly up on the property they bought which they were going to make into 3 condos and then found out that the neighborhood had a rule....no condos. Now you would think that they would have looked into all this before buying the property but they didn't. So the only thing we think their motivation for harassing us so was that we would buy the property to get them to stop. but we don't want the property. We have spent so much money to defend ourselves for such totally bogus claims....so many lies. But even one of their witnesses recanted his story and ended up saying that he was told to lie or lose his job. And of course we have an official document with photos showing that the gas tanks they said we stole are actually in their garage just sitting there. We climbed up and looked in the window. So these are bad people. And not Mexicans but Gringos. So we are now worried that they might try something else to harass us so we want to put them on the defensive so we will file a lawsuit to try and recover the money we have spent on this. The do own 3 properties down here so if nothing else we can put a lien on them. I just would like to recover some of the money and donate some to Madre Maria and the orphanage. When we were going through all of this and having to defend ourselves, Madre Maria came to court to be a character witness for us so I want to take care of her. She wanted to help us. So sweet but of course she knows how much we have done for her and the children for so many years. Anyway wish us well that we are able to get some of the funds we spent back.
Hope all my sparks buddies are doing great
Have a terrific day
Sallie

Glad you have your DH home for all of this! Wishing you all the best in court. It just never ceases to amaze me the depths to which some people stoop to make others miserable!

HUGS, best wishes and smiles. Good luck with the crown. For all you've been through, that is small potatoes for sure.

No dental insurance and my crown cost me $1100 in Colorado :(( and I had to wait 3 weeks for the permanent crown after having a temporary put in first.
I will definitely explore the dental care here in San Carlos next time I need one!
Congrats on the higher court upholding the decision. Best of luck with your counter suit!

Well Sallie I had 2 crowns put on last month I paid $485.00 for each tooth & that is with insurance. Now I had to wait 3 weeks for each tooth to come back. I was fitted with a temporary tooth on each one. The first tooth I was having something to eat & the temporary crown came off an hour after I came home. I had to go right back up & have them glue it back on. Then a few weeks later I had the second tooth done they put the temporary one on & guess what I swallowed it. Oh said to my husband oh jeepers I swallowed my crown !!!! I did not go back up because it was the side tooth. So they are really glued on now!!
( so I hope )
I pray you can get some of your money back with this on going mess. At least prayers were answered about the higher court. Take care Sallie

As a retired lawyer I find your post very interesting! It is always the case in any country, once you are sued, you have to defend yourself and that is costing a lot of money even if you are 100% innocent. The only people who benefit are the lawyers as they did their job and should be paid. Court rulings must (I think) have a punitive judgment on costs. Good luck with your endeavors to recuperate it.

You said "here in Mexico you can find an attorney to simply lie and find witnesses who will also lie" - I would dare say that that happens in all countries.

Sadly. as you have experienced/witnessed, some people have no qualms about making the choice of claiming a false witness. The threat of job loss is no good reason for making such a choice. I am happy to hear that you were able to counter the claims of your neighbors with truth.

I have no idea how much a crown would cost in the USA; however, I do know that some folks go over the border into Mexico to have dental work done because it cost less.

God bless!

Good luck to your with your court case. You're paying about one fourth the cost of a crown here in the Midwest.

Good deal on the crown. I think I paid more than that when I had my last crown about 15 years ago. I'm glad you made it through the higher courts successfully. I hope the criminals have to pay back some of your expenses and leave you alone.

Getting sucked into a court case is always expensive and unpleasant. Glad you are extricating yourself from this. When you mention "people just LIE" well...I know that's true. DH witnessed a car accident (truly reckless driving on the part of the guy who crashed) but DH had an appointment. Got to the appointment, then called police to say he witnessed the accident. Police said "go back as we'll need your info and you can't leave the scene" even though J wasn't involved. When he drove up the guy said "that's the man who caused the crash - he slammed on his breaks making me swerve into this other car!" Huh? DH was convicted for reckless driving and it took forever to get that cleared up. The guy had hired a witness who later came clean. It was crazy. Anyway, glad you are coming out of this. And enjoy the rain. CO is on fire right now...we could use some rain.

Courts are always a pain, seems the only real winners are the attorneys. Hope you prevail in this counter suit.

I'm sorry for the frustration and hassle you've gone through with these neighbors. I hope you can recover some of the money you've had to spend to defend against their bogus claims.

Happy rainy season! My faulty memory says the last crown cost $1,200 before insurance paid about half. I still had to wait a week or so for the crown to be made, but it's been a year or so ago.

Good luck with your neighbor situation. I know only too well how tough it is to have bad neighbors, but your story is outrageous. I can't imagine the stress helps your health issues, so I hope it is settled soon.
