emoticon I admit it spark friends...I'm in a TERRIBLE funk these days! I'm over worked at the consignment gallery...literally pooped from all the work that involves getting 3 house fulls of furniture in!

And...don't get me wrong...while I'm happy and grateful that so many customers want their furniture in our gallery (which is a grand compliment...and are willing to hold onto their stuff until we have space for it)...it still doesn't help me acquire the magical energy to place it in spite of those wonderful compliments!

Honestly..a LOT of my funk is this rotten house situation. It is literally draining the living life out of me fighting to hold on to it.

It might be time to cut bait. I HATE to admit that...I'm a fighter through and through and through but it's literally looking like the goliaths shall persevere.

Pretty sad in America when those with the most money are allowed to be criminals..right out there in broad daylight...and darn proud of themselves for being so slick!

Congress, the White House, and the judges here in Lee County FL...ALL know they have created bogus documents to substantiate their claims to steal hard working Americans homes. Sure there were some that might deserve to lose their home...there was plenty of house flipping going on here in FL ....but it surely wasn't US! Why lump everyone into a 'hey they got mortgages they couldn't afford...so they DESERVE to lose their homes pack?

We did EVERYTHING under the face of the sun to save this beautiful dwelling that we worked our GUTS out to buy back in 2001. We put a HUGE amount of money down as a down payment and the refinances that we did was simply pulling out equity that WE had already paid in to the place.

We did nothing other than asked for a fixed rate loan to protect our investment, we got the run around because we were self employed and depended on a friend that was a broker that put us into a sub prime loan. WHY...not because our credit was bad...but because THEY got a higher commission rate! With friends like THAT...who needs enemies...right?

Sooooo long, long...loooooonnnng story short when the housing industry went bust here in 2008..so did we. We were self employed for over 20+ years in the housing industry. Do you realize just how FAST you can run out of a year's savings when you are paying a mortgage that adjusts EVERY friggin' SIX months! That's when the rates were tied to the LIBOR rate (another criminal travesty) and when you DON'T have work because people surely aren't spending to fix up their homes that have NO value....what DO you do? You call your mortgage company explain your story... that you only have a year of savings and ask them to work with you.

Well we ALL know the end of THAT story...GMAC did nothing to help..finally telling us that we HAD to go late before they would even CONSIDER a modified payment.

After a year of groveling for that help AND making NINE months of perfect on time trial modification payments they were still doing their dirty work, manufacturing their fraud, and going about the foreclosure action the entire time.

I've got to tell you..I hope there is a SPECIAL place in hell for these crooks! To lie each and every month when I called in our payment and asked them if they REALLY intended on helping us...or if they were just taking more money padding their pockets they said..."Oh sure we are helping THOUSANDS of homeowners EVERY single day!"

Lies...can you IMAGINE how I felt when one month they refused the payment...simply saying...sorry your file has been flagged for foreclosure!

Wow...this is how it works boys and girls...this is how the mighty eat the minnows. THIS is WHAT WE have allowed to happen to us..because of our lackadaisical interest in the crooked policy makers that govern us.

They've got THEIRS...so why worry about the minions that pay for it. It's just unadulterated rubbish...do I sound disillusioned...yep that would sum it up in a nutshell.

All I can say that if this were France there would be blood and rebellions in the street.

Instead we allow ourselves to be thrown out of our most coveted asset...our castle, our home...literally kicked to the curb. It's absolutely so pitiful I don't have words.

GMAC has quietly filed for bankruptcy protection and has sold off their assets to a new servicer. This new servicer even though they have absolutely NO standing in accepting a flawed and fraudulent non performing loan will most likely file as the new plaintiff before the court...and the bogus judges will allow the bogus claim most likely to stand.

That means that even though we have a fraud riddled foreclosure, simply by putting a new face before the court...we will most likely lose.

Yep...that's just how they do it in America my friends. Aren't you proud to be an American, can't say I am at the moment.

Don't you WISH you could get by with this 'in your face' debauchery? I want something so I'll steal it...no repercusions...I'll just steal it and then I'll convince the court system which is supposed to provide due process of PROOF that I actually own it so I can take it back.

Well...we'll just throw money at it and sidestep that nasty little technicality.

Yep...it's pathetic, but it's a fact of life. I'm telling you...if I weren't so tired from working such crazy back breaking hours...I'd march on Washington.

Life goes on...even when we wish we'd hit the lottery and use the proceeds to put these crooks behind bars...a few million should be able to buy off a judge somewhere! Yep...I got THAT lesson...that's how it's done in America! emoticon emoticon

    I'm so sorry you are in a funk, that you are overworked at the gallery and that things don't seem to be going your way with keeping your home! I know that you are not the only one who would march on Washington. I think some first time home buyers were too naive and stupid to understand that they couldn't really afford the homes they bought. I know a lot of people went out and took 2nd mortgages on their homes so they could go out and buy stuff they didn't really NEED. I also know though, that there were many people like you and your DH that were paying their mortgages on time until the economy went into the crapper and they lost their jobs or whatever. I'm still keeping my fingers crossed for you!

    Thank you. I did believe that most people who lost there homes were 'stupid people' for taking out huge mortgages that they had no reasonable way to pay off. Thanks for clearing that up a bit for me. It just blew my mind (as a recent first time buyer) that some people would think they could afford the homes they bought. I watched "Inside Job" and it clearly outlines the, dare I say, evil ways that home buyers were screwed over and I mostly thought the companies had taken advantage of 'stupid people.'

But, your story finally let me see that it wasn't all 'stupid people'. I hope you're court case goes your way and that you can find some peace after the $hit storm that just rolled through your life.

    I know what you mean about getting tired of fighting battles that are all uphill. Sometimes we need to reassess as life is too short. Happiness doesn't depend upon a house and living a more stress free life could pay off with huge benefits you can't even imagine. My DH is being sued for $1MM + dollars (might as well be 100MM!!) from an accident he was involved in last year... and my attitude? Oh well, what is the worst that can happen? We lose stuff? Won't rob me of my health and happiness... and that my friend is the most important thing!
